In this document, we provide essential information regarding the purposes and methods of processing personal data in response to your inquiries. Additionally, we inform you about the procedures for providing offers and documents related to contracts, as well as the rights available to you in connection with this process.

This policy also describes the rules for using the websites available at https://www.actemium.pl (“Service”). Therefore, please read it carefully before using the Service and its functionalities. If you do not agree with the content of the Policy, please refrain from using the Service.

General information

In fulfilling our obligations under the General Data Protection Regulation (GDPR) 2016/679, we would like to inform you that Cegelec Sp. z o.o., with its registered office in Katowice, at ul. Zygmunta Krasińskiego 29, 40-019 Katowice, is the controller of your personal data. This company is registered in the National Court Register kept by the District Court Katowice-Wschód in Katowice, VIII Economic Department, under the KRS number 0000111348. The Tax Identification Number (NIP) is 526-26-16-667, and the share capital amounts to PLN 8,650,000.00. In the rest of this document, we will use terms such as “Actemium”, “we”, “our”, or “us”, which refer to our company.

Providing your personal data in connection with using the Service or corresponding with us, such as requesting offers or entering into agreements with Actemium, is voluntary. However, in some cases, it may be necessary to provide certain personal data for us to conduct an analysis, prepare an offer, conclude and execute an agreement with Actemium, respond to your inquiries, fulfill our legal obligations, and achieve other purposes described in further parts of this Policy.

Rules for using the Service

All content posted on the Service’s websites, including trademarks, photos, product descriptions, and other materials, is legally protected, and their use is possible only with the prior written consent of Actemium or other relevant entities, especially those from the VINCI Group.

Using the Service and its features, including the contact form, requires access to the Internet and having an active and properly configured email account. Additionally, it is necessary to use the current version of an internet browser, such as Internet Explorer, Chrome, Firefox, Opera, or Safari.

It is prohibited to use the Service in a way that would disrupt Actemium’s or its users’ use of it. Furthermore, providing illegal content through the Service, including infringement of personal rights and other rights of third parties, acting unlawfully or attempting to circumvent the law, as well as actions contrary to the principles of social coexistence or good manners, are prohibited.

Actemium may enable ordering free technical-industrial information and current offers from Actemium or the VINCI Group through the Service in the form of a newsletter. Newsletter dispatch takes place solely at your request, and you may withdraw your consent to receive it at any time or object to the processing of your data for marketing purposes.

Actemium implements technical measures in the Service aimed at protecting electronic communication. Nevertheless, using the Internet and electronic services always carries the risk of unauthorized access to transmitted data. Therefore, we recommend implementing appropriate security measures on your devices accessing the Internet.

Cookies

Actemium may use cookies (small text files downloaded to a user’s computer, which can be used to store information about the user and their preferences) and other similar technologies to fully utilize the Service’s functionalities and display personalized advertisements, as well as to monitor traffic on the Site and visitor statistics. The Service may also contain so-called social and marketing plugins, which may also use cookies.

You can change the settings of the internet browser you use at any time by specifying the conditions for storing cookies through independently changing the settings of the internet browser, and also delete them independently, although this may affect the availability of the Service’s functionalities.

Purpose of processing personal data by Actemium and legal basis for processing

Depending on the specific situation, Actemium processes personal data for purposes necessary for contacting, concluding contracts, and cooperating with Actemium. This applies particularly to the following circumstances:
  • Processing of personal data by Actemium in the context of presenting an offer, concluding or performing a contract with our Partners, Clients, Contractors, Subcontractors, Suppliers, Service Providers, and persons indicated by you (including your employees and collaborators), as well as persons interested in Actemium’s offer, is carried out to present an offer or conclude and perform a contract. The legal basis for this processing may be Actemium’s legitimate interest, which is direct marketing of our products or services, enabling communication with you, and preparing for the conclusion and performance of a contract. Additionally, personal data may be processed to fulfill legal obligations, such as issuing an invoice or ensuring security during contract performance. Providing personal data is always voluntary, but it may be necessary to conclude and properly perform a contract. In the described situations, Actemium processes personal data for a maximum period of conducting business activity, but not shorter than the duration of the contract concluded with you and the duration of proceedings. Data will be stored until the end of the year in which claims related to contract performance that require processing of personal data by Actemium expire, or for as long as necessary to achieve Actemium’s or another third party’s legitimate interest.
  • Individuals contacting Actemium – the purpose of processing personal data is to enable communication with individuals contacting Actemium. The legal basis for processing personal data is Actemium’s legitimate interest, which consists of enabling communication, establishing a potential relationship with the contacting person, and providing necessary information. The content of the correspondence may include, in particular, data such as name, surname, email address, telephone number, mailing address, and other information provided by the person contacting Actemium. Providing personal data is voluntary, but in case of failure to provide it, the communication process may be difficult or impossible to implement. Regarding inquiries about offers, products, information, and cooperation terms, your data may be stored for the duration of Actemium’s business activity or until a request to delete data and inquiry content from the database is received. Data will also be stored as long as necessary to achieve Actemium’s or another third party’s legitimate interest.
  • Other legitimate purposes of Actemium. Based on Actemium’s legitimate interest, Actemium may use various functionalities in the Service for the following purposes:
    • Conducting research and analyzing your and other users’ activity on the Service to improve its performance, assess users’ expectations and needs, and improve the Service.
    • Introducing new products and services and conducting statistical activities.
    • Providing you with commercial information, marketing content, and technical information related to products or services offered by us or our partners, in accordance with applicable laws, including with your consent, using various available means of communication.
    • Organizing or co-organizing promotional campaigns for Service users.
    • Communicating with you for purposes other than those directly related to the possibility of concluding and performing a contract.
    • Ensuring the security of using the Service, preventing fraud and abuse, and maintaining its correctness and continuity of operation, including creating backups.
    • Determining, investigating, or defending Actemium’s claims and fulfilling obligations arising from legal regulations, including creating registers and records in accordance with personal data protection regulations and archiving this data.
If consent or our legitimate interests are the basis for processing your data in any case, we will process your data for the duration of our business activity or the duration of a specific action, until the consent is withdrawn or the objection, which is justified by your particular situation, is positively considered.

In the context of processing data for the purposes described above, Actemium does not profile you based on available personal data. This means that Actemium does not use systems leading to automated decision-making regarding you.

Actemium implements technical and organizational measures ensuring appropriate protection of processed personal data, tailored to the type of threats and categories of your data protected. In particular, the company provides technical and organizational safeguards to prevent unauthorized access to data, prevent their theft or unauthorized access, and ensure protection against alteration, loss, damage, or destruction of data in accordance with applicable laws.

Data recipients

In principle, only authorized employees and collaborators of the company have access to personal data processed by Actemium, as well as persons responsible for servicing the Service, who have been granted appropriate authorizations. Access to this data may also be granted to cooperating entities (or entities cooperating with us and you) to the extent justified during the implementation of specific projects.

Personal data provided by you may be disclosed to entities authorized to receive them under applicable law, especially law enforcement authorities.

In accordance with applicable law, we inform you that your data may be transferred by Actemium to entities that process them on the company’s behalf, such as carriers, postal operators, persons responsible for servicing and maintaining IT systems and websites, advisors, banks, and payment service providers, as well as accounting offices providing accounting services for Actemium. Such entities process data based on agreements concluded with Actemium and only to the extent necessary to provide services in accordance with our instructions.

Additionally, we inform you that Actemium does not intend to transfer your data to third countries outside the European Economic Area unless necessary in the context of contract performance, of which Actemium will inform you in advance. If transferring data to a third country proves necessary or justified, it will be done in accordance with applicable law.

Rights related to the processing of Your personal data

In accordance with the General Data Protection Regulation (GDPR), individuals whose data are processed have various rights arising from the processing of their personal data, including:
  • Right to access personal data, including the right to obtain a copy of such data.
  • Right to request correction (rectification) of personal data if inaccuracies or deficiencies are noticed.
  • Right to request deletion of personal data (the “right to be forgotten”) if this data is no longer necessary for the purposes for which it was collected or otherwise processed, or if you object to the processing of data, withdraw consent on which the processing was based, there is no other legal basis for processing, data is processed unlawfully, or must be deleted in accordance with a legal obligation.
  • Right to request restriction of processing of personal data if you notice inaccuracies in the data, processing is unlawful, but you do not want the data to be deleted, we no longer need the data, but you need it to establish, defend, or pursue claims, or if you object to the processing of data – until it is determined whether our legitimate basis for processing data prevails over the basis of your objection.
  • Right to data portability if processing is carried out automatically based on a contract concluded with you or based on your consent.
You also have the right to object to the processing of personal data, including profiling if we process your data based on our legitimate interest, and your objection is justified by your particular situation. In the case of processing personal data based on your consent, you have the right to withdraw it at any time, but the withdrawal of consent will not affect the lawfulness of processing carried out based on consent before its withdrawal.

You can submit all requests regarding the exercise of the above-mentioned rights in writing or by email to the Actemium addresses provided above. We will make every effort to respond to your requests promptly, no later than within one month of their receipt, unless these requests prove to be particularly numerous or complex. All requests are free of charge; however, in case of obvious unfoundedness or excessive number of requests, we reserve the right to charge a reasonable fee, taking into account communication or action costs, or to refuse to take action regarding the request.

If you believe that Actemium has violated the provisions on personal data protection during the processing of your data, please contact us using the data provided above. Additionally, you retain the right to lodge a complaint with the supervisory authority, which in Poland is the President of the Office for Personal Data Protection.

Disclaimer

This Privacy Policy does not cover any information regarding services or goods offered by entities other than Actemium, including entities from the VINCI Group, which have been commercially posted on the Service’s pages, hosted, on reciprocity terms, or are not intended for direct or indirect commercial effect.

Actemium is not responsible for actions or omissions of users resulting in the processing of their personal data by Actemium in accordance with the provisions of this Privacy Policy.

Actemium reserves the right to introduce changes, withdraw, or modify the features or properties of the Service’s websites, as well as to cease operations, transfer rights to the service, and take any legal actions permitted by applicable law. All actions taken by Actemium must not violate the rights of users.

Actemium also reserves the right to amend the Privacy Policy at any time.
